Mr Fix

Terms of Service

These Terms apply when you leave a device with a Mr Fix store in Gaithersburg, MD, Washington, DC, Falls Church, VA or Burke, VA, send a request through localdevicefix.com, text a store, or use this site. The stores are operated by MR FIX DMV REPAIR (the Gaithersburg, MD and Washington, DC stores) and MR FIX DMV (the Falls Church, VA and Burke, VA stores). “Mr Fix,” “we” and “us” mean the company that operates the store you deal with; it alone is responsible for that store’s work, calls and texts.

1. Agreement

By leaving a device with us, approving work in person, by phone or by text, or sending a request through this site, you (“you,” “Customer”) accept these Terms together with the work order or receipt for your device. “Services” means diagnosis, part replacement, board-level and liquid damage work, data retrieval and any related work we do on your device. If you do not agree, please do not approve any Services.

2. Prices and quotes

Prices on this site and in its price tool are starting prices for the usual job on that model. Your final price is written down and agreed before any work starts. If we find another problem along the way, we ask you before going over the agreed price. Prices may change without notice, and a mistake on the site does not bind us to a wrong price.

When a device needs a diagnosis before we can quote, we tell you any diagnostic fee before we start. The fee pays for the diagnosis, is earned once the diagnosis is done whatever it finds, and is credited toward the job if you go ahead.

3. Your approval and ownership

By approving Services you allow us to open, take apart, test and run diagnostics on your device, install or update software where the work needs it, and do the work you approved. You confirm that you own the device or are allowed by its owner to approve the work. We may refuse any device, including one we believe is lost or stolen, and we cooperate with law enforcement when asked.

4. Payment and deposits

Payment is due in full when the work is done, before the device is released. For a special order or non-returnable part we may ask for a deposit, which cannot be refunded once the part is ordered. Unpaid balances may carry interest and reasonable collection costs as the law allows.

5. If you decline the work

If you decline the work after a diagnosis, any diagnostic fee you agreed to stays due, and we put the device back together as far as reasonably practical and return it. A device that did not work when you brought it, for example one with no power or liquid damage, may come back in the same condition; a diagnosis or partial disassembly does not fix it.

6. Risks of the work

Some work carries real risk: liquid damage, board-level and micro soldering work, bent or cracked frames and boards, devices with no power, devices opened or worked on before, and data retrieval. During this work a device can get worse, stop working altogether or turn out to be beyond saving, even with full professional care, because of corrosion, worn components or earlier damage we did not cause. Once a device has been opened, we cannot promise its factory water resistance. By approving such work you accept these risks.

7. Your data

You alone are responsible for backing up your data before you leave a device with us. To the fullest extent the law allows, we are not liable for any loss, corruption or exposure of data, software or settings during or because of the Services, including data retrieval attempts that do not succeed. This does not apply to loss caused by our gross negligence or willful misconduct.

8. Parts

We tell you which kind of part your job uses before we start, and it is written on your receipt:

  • Original (OEM): made or supplied by the device maker.
  • OEM grade: high quality parts from another maker, built to the original specifications.
  • Aftermarket: compatible parts from another maker that may differ from the original in materials, brightness, color or features.
  • Used: original or compatible parts taken from another device and tested by us.

We never call a part original when it is not. Some makers show a notice such as “Unknown Part” or “Non-Genuine Part” after a part change and log it in the device’s service history. That notice comes from the maker, not from us, does not mean the part is faulty, and cannot be removed by us. Depending on the device and the part, features such as True Tone, auto brightness, battery health readings, Face ID, Touch ID or camera functions may be limited; we tell you about any known limit for your job before you approve it.

Under federal law (the Magnuson-Moss Warranty Act), an independent shop’s work and non-original parts do not by themselves void your maker’s warranty, although the maker may refuse to cover a problem it traces to the replaced part.

9. Warranty

The warranty on our work is stated on your receipt. It covers the part we installed and the work we did, for the period stated there. It does not cover new physical or liquid damage, misuse, or a device opened or worked on by anyone else after us. Under the warranty we will, at our choice, redo the work, replace the part, or refund what you paid for that part of the job. Where the law does not allow an implied warranty to be excluded, it lasts no longer than our written warranty.

10. Limitation of liability

To the fullest extent the law allows, our total liability for any claim about the Services or your device, whether in contract, tort or otherwise, is limited to the amount you paid us for the specific service the claim is about. We are not liable for indirect, incidental, consequential, special or punitive damages, including lost data, lost profits, loss of use, or the cost of a replacement device. Nothing in these Terms limits liability that the law does not allow to be limited, including for gross negligence, willful misconduct, fraud or personal injury.

11. Pickup and unclaimed devices

When your device is ready, or when we decide no work will be done, we tell you by the contact you gave us (the “Notice Date”). Please pick the device up within 15 days of the Notice Date. From day 16 we may charge storage of $3 per device per day, added to your balance.

A device not picked up and paid for within 90 days of the Notice Date is treated as abandoned. Under the lien laws of the state or district where the store is located, we hold a lien on the device for all charges and, after the notice and waiting period those laws require, may sell or otherwise dispose of it and apply the proceeds to your balance; any surplus is handled as the law requires. After the device is abandoned we may erase all data on it, and a device with little or no resale value may be recycled.

12. SMS Terms

Mr Fix store texts. When you check the optional box for texts on our request form, text a store first, or ask a store to text you, the Mr Fix store you chose may text you from that store’s number about your request and your device: your quote, your visit, the status of the work and when your device is ready. Texts are optional and not a condition of any purchase; without them we call you instead.

  • Texts from the Gaithersburg and Washington stores are sent by MR FIX DMV REPAIR, texts from the Falls Church and Burke stores by MR FIX DMV.
  • Message frequency varies with your request.
  • Message and data rates may apply.
  • Reply STOP to stop texts at any time. You will get one text confirming it, and no more texts unless you text us again.
  • Reply HELP for help, or email support@localdevicefix.com.
  • Agreeing to texts is not a condition of any purchase.
  • Carriers are not liable for delayed or undelivered messages.

How we handle your number is in our Privacy Policy.

13. Using this site

The information and prices on this site are given as is and may change. Please do not misuse the site, send false requests or try to break or overload it. When you attach photos to a request, you confirm you may share them and allow us to use them to quote and service your device. Please do not include other people’s personal information.

14. Disputes, arbitration and class action waiver

If you have a problem, contact us first at support@localdevicefix.com or at the store, and give us 30 days to put it right. If we cannot settle it, any dispute about these Terms or the Services will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in the county or district where the store that served you is located, under the Federal Arbitration Act.

You and we may bring claims only individually, not as a plaintiff or class member in any class or representative proceeding.

Either of us may take an individual claim to small claims court instead. You may opt out of this section by emailing us within 30 days of first accepting these Terms; disputes then go to the courts named below. Nothing here waives a consumer right that the law of Maryland, the District of Columbia, Virginia or your state does not allow to be waived.

15. Governing law

These Terms are governed by the law of the state or district where the store that served you is located, Maryland for Gaithersburg, the District of Columbia for Washington and Virginia for Falls Church and Burke, and by the Federal Arbitration Act for section 14. Subject to section 14, the state and federal courts for that location have exclusive jurisdiction.

16. General

If any part of these Terms is found unenforceable, it is changed only as much as needed or removed, and the rest stays in force. These Terms, with your work order and receipt, are the whole agreement about the Services. We may update these Terms for the future; the version in effect when you approve a service applies to that service.
